Terms and Conditions

  1. General

1.1 These Terms and Conditions (“Terms”) apply to all services and products provided by Simmonds Heating and Cooling (“we”, “our”, “us”) to our clients (“you”, “your”, “customer “).

1.2 Acceptance by the client to proceed with supply of goods or services constitutes acceptance of the terms and conditions contained in this document.

1.3 “Goods “and “Services” means all products and services provided by Simmonds Heating and Cooling  “Company” to the Customer.

  1. Quotations and Pricing

2.1 All quotes are valid for 30 days unless otherwise specified.

2.2 Prices are subject to change without notice unless a written quote has been accepted.

2.3 Any variation to the original quote, including site conditions or customer requests, may incur additional charges.

2.4 We reserve the right to request a deposit prior to commencement of work.

2.5 In the event that unforeseen costs are necessary, such as the discovery of hazardous materials or situations, this will constitute a variation to the quotation and be the responsibility of the customer.

  1. Acceptance, Bookings and Cancellations

3.1 By placing an order or accepting the provision of Goods and Services from the Company, the Customer agrees to be bound by these Terms and Conditions.

3.2 Bookings are confirmed upon acceptance of the quote and/or payment of a deposit (if applicable).

3.3 At least 24 hours’ notice is required for cancellations or rescheduling.

3.4 Cancellations may incur a call-out or cancellation fee.

  1. Payment Terms

4.1 Payment is due on the day of attendance, unless otherwise agreed in writing.

4.2 We accept EFT, credit card, and cash payments.

4.3 Overdue payments may incur interest at a rate of 2% per month.

4.4 The Customer shall be liable for all contract default fees incurred by Simmonds Heating and Cooling in recovering any unpaid amounts, including but not limited to legal fees, administrative charges, and third-party debt collection agency fees.

  1. Warranty and Liability

5.1 We provide a 5 year workmanship warranty on new system installations only and pass on all manufacturer warranties for equipment installed.

5.2 Warranty claims must be made in writing with proof of purchase.

5.3 Warranty is void if products have been tampered with, misused, not serviced , or serviced by an unauthorised party.

5.4 To the extent permitted by law, we are not liable for indirect, incidental, or consequential loss or damage.

  1. Access and Safety

6.1 You must provide clear and safe access to the premises and all areas relevant to the work.

6.2 If access is delayed or unsafe, we reserve the right to reschedule or charge additional fees.

  1. Delivery and Completion

7.1 We will make reasonable efforts to meet delivery or completion timeframes but shall not be liable for any delays due to circumstances beyond our control.

  1. Ownership of Goods

8.1 All goods remain the property of Simmonds Heating and Cooling until full payment is received.

8.2 We reserve the right to reclaim any unpaid goods.

  1. Governing Law

9.1 These Terms are governed by the laws of South Australia.

9.2 Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.

  1. Privacy

10.1 We collect personal information in accordance with Australian Privacy Principles.

10.2 Information collected will only be used for business purposes and will not be shared without your consent unless required by law.
